Medical bills and health care debt is known as unsecured debt. The hospital can't ask for a return of your surgery or repossess anything, so it must discharge the debt. There are two ways in which bankruptcy can eliminate your medical bills and health care debt.
- Chapter 7 bankruptcy — If you pass the means test, your medical bills are entirely discharged or eliminated with a Chapter 7 bankruptcy.
- Chapter 13 bankruptcy — If you do not pass the means test, a Chapter 13 bankruptcy will create a three-to-five-year repayment plan for all of your debts. At the end of the three-to-five-year dept repayment time period, any remaining medical debt will be eliminated.
